O neg\u00f3cio foi consumado em 2014, mas s\u00f3 foi notificado ao Cade em 2016, contrariando a legisla\u00e7\u00e3o que exige an\u00e1lise pr\u00e9via do conselho. Por isso, as duas empresas foram multadas. A transa\u00e7\u00e3o, no entanto, ainda aguarda decis\u00e3o.<\/p>\n<p>Nesta sexta (28), o conselheiro relator do caso, Alexandre Macedo, deve pedir mais tr\u00eas meses para decidir seu voto antes de lev\u00e1-lo a julgamento. Caber\u00e1 a Macedo decidir se a opera\u00e7\u00e3o deve ser desfeita porque, segundo a Superintend\u00eancia-Geral do Cade, as duas empresas fazem parte do mesmo grupo econ\u00f4mico.<\/p>\n<p>Procurada, a Mataboi n\u00e3o havia se pronunciado at\u00e9 a conclus\u00e3o desta edi\u00e7\u00e3o. A JBS informou n\u00e3o ter nenhuma rela\u00e7\u00e3o societ\u00e1ria com a JBJ.<\/p>\n<p>A JBS tamb\u00e9m poder\u00e1 sofrer san\u00e7\u00f5es por descumprimento de uma decis\u00e3o anterior do Cade, que imp\u00f4s limites de compras \u00e0 JBS.<\/p>\n<p>Alvo da Opera\u00e7\u00e3o Greenfield, Joesley e Wesley tiveram de deixar o comando da JBS por decis\u00e3o judicial em setembro. Durante o afastamento tempor\u00e1rio, J\u00fanior assumiu a presid\u00eancia da JBS e do conselho de administra\u00e7\u00e3o.<\/p>\n<p>J\u00fanior ficou um dia na fun\u00e7\u00e3o, mas foi o suficiente para que a Superintend\u00eancia do Cade usasse o fato como forte evid\u00eancia de que a JBJ e a JBS fazem parte do mesmo grupo econ\u00f4mico e que a JBJ estaria atuando de forma orquestrada na burla da decis\u00e3o que imp\u00f4s limites para compras de frigor\u00edficos pela JBS.<\/p>\n<p>At\u00e9 a posse de J\u00fanior na JBS, a \u00e1rea t\u00e9cnica do Cade j\u00e1 questionava se a rela\u00e7\u00e3o de parentesco entre os controladores das duas empresas j\u00e1 n\u00e3o traria efeitos concorrenciais danosos ao mercado.<\/p>\n<p>J\u00fanior se retirou do capital da J&amp;F em mar\u00e7o de 2013 e do conselho da JBS logo depois.
